In accordance with the current Ukrainian legislation, trading through the online store is considered to be distance trading. The contractual relationship between the buyer and the seller is formalized in the form of a public offer agreement. By fully agreeing to this Agreement, the Buyer accepts the terms and conditions of placing an order, paying for the goods, delivering the goods, and being liable for a bad faith order and for failure to fulfill the terms of this Agreement.
The Agreement is considered concluded from the moment you click the “PLACE ORDER” button on the ordering page and confirm your purchase. If necessary, at the request of the buyer, the agreement may be executed in writing.

1.1 The terms of the agreement are the definitions contained in this agreement and are its integral part.
1.2 The definitions shall be interpreted based on their essence and the meaning of this agreement. Below is a list of these definitions:

Buyer – any legally capable individual, legal entity, individual entrepreneur, in accordance with the current Ukrainian legislation, who has visited the website www.sis-cashmere.com, intending to purchase a particular product and pay for the receipt of such product.
Seller – SIS Cashmere, the owner of the goods offered on the website of the online store www.sis-cashmere.com.
General provisions
2.1 This public offer (hereinafter referred to as the agreement) defines the peculiarities of the sale and purchase of goods on the website www.sis-cashmere.com.

4.3 The fact of purchase of the Goods is the Buyer’s unconditional acceptance of the terms of this Agreement.
The Buyer who has used the services of www.sis-cashmere.com is considered as a person who has entered into a contractual relationship with the Seller.
Rights and obligations of the parties.
5.1 www.sis-cashmere.com undertakes to transfer the goods to the Buyer.
The goods must be transferred:
in a certain place
together with other devices and documents related to the goods
in a certain quantity
in the appropriate complete set and in a set, if any
of proper quality
free from claims of third parties
The Seller undertakes to inform the Buyer of the necessary and reliable information.

5.1.1 From the moment of conclusion of this Agreement, to fully fulfill all obligations to the Buyer in accordance with the terms and conditions agreed upon in the aggregate by the website www.sis-cashmere.com and this Agreement. www.sis-cashmere.com reserves the right to default in the event of force majeure.
5.1.2 Not to disclose any private information about the Buyer and not to provide access to this information to third parties, except as provided by law or at the request of the Buyer.
5.2 www.sis-cashmere.com has the right:
5.2.1 To change the terms of this Agreement, as well as the Tariffs (prices) for the Goods and services, unilaterally by posting them on the website at: www.sis-cashmere.com.
5.2.2 All changes shall take effect immediately upon publication.
5.3 The Buyer undertakes:
5.3.1 Prior to the conclusion of the Agreement, familiarize yourself with the content of the Agreement, the terms of the Agreement and the tariffs (prices) offered by the Seller on all pages of the website www.sis-cashmere.com.
5.3.2 In order for the Seller to fulfill its obligations to the Buyer, the latter must provide all the necessary data that uniquely identify him as the Buyer and are sufficient to deliver the paid Goods to the Buyer.
DISCLAIMER OF WARRANTIES.
6.1 The Seller does its best to ensure the quality of the services provided to the Buyer. Verbal advice and information given to the Buyer cannot be considered as a guarantee.
6.2 The Parties shall be released from liability for non-fulfillment or improper fulfillment of obligations under the Agreement for the duration of force majeure. Force majeure means extraordinary and insurmountable circumstances under the given conditions that prevent the Parties from fulfilling their obligations under this Agreement. They include natural phenomena (earthquakes, floods, etc.), circumstances of public life (military operations, states of emergency, major strikes, epidemics, etc.), prohibitive measures of state authorities. During this time, the parties have no mutual claims, and each party assumes the risk of the consequences of force majeure.
PROCEDURE FOR DETERMINING THE PRICE OF GOODS.
7.1 Prices for the Goods and services of the website www.sis-cashmere.com are determined in the relevant sections of www.sis-cashmere.com.
7.2 Prices for Goods and services may vary depending on market conditions.
The Seller may not change the price for a particular Buyer if the latter has already accepted the Seller’s terms and conditions and made payment for the goods (services) in accordance with the terms of this Agreement.
8. VALIDITY OF THE OFFER.
8.1 The validity of this offer is set by the Seller.
8.2 The offer may be withdrawn by the Seller at any time, which is not a ground for refusal to fulfill obligations for sales already made.
9.1 DELIVERY OF GOODS.
9.1 The Buyer receives the Goods by delivery or receives them personally. The procedure for payment and receipt is indicated on www.sis-cashmere.com.
9.2 When delivering goods to other cities of Ukraine, which is carried out by other Delivery Services on the terms of cooperation with SIS Cashmere, (namely, Nova Poshta, hereinafter referred to as the Carrier Company), the Buyer fully and unconditionally agrees to the Rules of cargo transportation of Nova Poshta, which are available on the website of the Carrier Company Nova Poshta and the terms of www.sis-cashmere.com.
9.3 Shipment of the Buyer’s order takes place after receipt of 100% payment of the invoice from the Buyer.
9.4 The Buyer confirms the fact of receipt of the goods and the absence of claims to the quality of the goods by his own signature on the invoice upon receipt of the goods.
9.5 The Buyer shall pay the delivery cost to the Carrier Company independently, at the time of delivery of the goods. The exact cost of delivery is determined by the Carrier Company and announced by the company’s courier upon delivery of the goods to the Buyer.
The cost of delivery includes the tariff for transportation according to the current price list of the carrier, insurance and the cost of return delivery of the invoice signed by the Buyer. Employees of the online store, at the request of the Buyer, may provide the Buyer with the estimated cost of delivery for informational purposes only.
9.6 In case of the Buyer’s absence at the delivery address specified by the Buyer in the application or the Buyer’s refusal for a reason other than specified in clause 9.7 to receive the goods upon delivery by the courier of the Carrier Company, the goods shall be returned to the Seller. Payment for the services of the Carrier Company shall be deducted from the amount transferred by the Buyer for the goods to www.sis-cashmere.com. The balance of the amount shall be returned to the Buyer on the basis of his letter sent to the address: info@info@sis-cashmere.com indicating the current account to which the funds should be returned.

In case of unwillingness to receive such information, the Buyer may write a letter of refusal to receive information to the address www.sis-cashmere.com.
10.3 All disputes and disagreements arising in the performance of the parties’ obligations under this Agreement shall be resolved through negotiations.
If they cannot be resolved, the parties have the right to seek judicial protection of their interests.
